Welcome to Nextbook.org, the web site ("Site") for Nextbook, Inc. ("Nextbook" or "we"). This is the agreement that governs your use of Nextbook.org ("User Agreement"). It includes Nextbook's privacy policy ("Privacy Policy"). Please read the User Agreement and Privacy Policy carefully, because by visiting or using the Site, you agree to follow the rules contained in them. From time to time, we may modify our User Agreement, including our Privacy Policy. If such changes are significant, we will place a notice on our log-in page and post the changes on this web page, so please review them periodically for changes. Unless otherwise indicated, your continued use of Nextbook.org after any modifications indicates your agreement to the modified terms.

Privacy

Please review our privacy policy, which also governs your use of Nextbook.org and explains what information we collect when you visit Nextbook.org, how we collect it, how we use it, and how we protect it.

Copyright

Nextbook and all its contents, such as text, graphics, photographs and software, is owned by or licensed to Nextbook and is protected by United States and international copyright laws and other intellectual property laws.

You may occasionally reproduce, distribute, display or transmit an insubstantial portion of Nextbook.org content solely for personal and noncommercial uses and solely for a limited number of individuals, provided that you include all trademark, copyright, and other proprietary rights notices in the same form in which the notices appear on Nextbook.org. Except for the purpose noted above, you may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in selling or exploit in any way, in whole or in part, our Site, any of its contents, or any related software.

Trademark

"NEXTBOOK," the arrow design, and other trademarks, logos and indicia of source displayed on Nextbook.org (collectively "Trademarks") are owned by Nextbook. The Trademarks may not be used in connection with any product or service that does not belong to Nextbook or in any manner that is likely to cause confusion about whether Nextbook is the source, sponsor, or endorser of the product or service and may not be used in any manner that disparages or discredits Nextbook.

Letters to the Editor

We invite your letters to the Editor, questions or comments about Nextbook or any of the issues addressed on Nextbook.org. You grant Nextbook a nonexclusive license to reproduce, distribute, print, and publish any letters to the Editor you send by email or in hard copy, in whole or in part, for any purpose in any media, whether now known or hereafter established. Hard copies will not be returned to you. Please review our privacy policy to learn about the personally-identifying information we will need from you to accept a letter to the editor.

We welcome criticism and debate but to ensure a civil online environment, please be advised that we will not post any letters to the Editor containing content we find to be libelous, obscene, abusive, or threatening, or that infringes any third party's copyright or other proprietary rights, or violates anyone's right of privacy or publicity.

Links to Nextbook.org, Frames, and Metatags

You may not link to the home page of Nextbook.org in any way that might cast Nextbook in a false or misleading light. You may not frame Nextbook.org content so that it is viewed on another site. You may not use metatags or any other "hidden text" that incorporates the name Nextbook or the Trademarks without our express written consent.

Links to Other Web Sites

Our Site contains links to other web sites that contain information we think might interest you or from which you can order books. We have no control over these sites or their content. Remember that when you click on a link and leave Nextbook.org for another site, you should read that site's terms of use and privacy policy before using the site.

Disclaimers

ALTHOUGH NEXTBOOK INTENDS TO TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES, WORMS, "TROJAN HORSES" OR OTHER DESTRUCTIVE MATERIALS TO OUR SITE, WE DO NOT GUARANTEE OR WARRANT THAT OUR SITE OR MATERIALS THAT MAY BE DOWNLOADED FROM IT ARE FREE FROM SUCH DESTRUCTIVE FEATURES. WE ARE NOT LIABLE FOR ANY DAMAGES OR HARM ATTRIBUTABLE TO SUCH FEATURES.

Limitation of Liability

NEXTBOOK AND OUR OFFICERS, DIRECTORS AND EMPLOYEES ARE NOT LIABLE FOR ANY CLAIM, LOSS OR INJURY BASED ON ERRORS, OMISSIONS, INTERRUPTIONS OR OTHER INACCURACIES IN OUR SITE, NOR FOR ANY CLAIM, LOSS OR INJURY THAT RESULTS FROM YOUR USE OF OUR SITE OR YOUR BREACH OF ANY PROVISION OF THIS USER AGREEMENT.

Termination

We reserve the right to terminate this User Agreement, including its Privacy Policy section, at any time without notice for any reason, including for a user's violation of any of the User Agreement provisions. The Limitation of Liability and Governing Law sections of this User Agreement survive any termination.

Agreement is Governed by the Laws of New York

This User Agreement, including its Privacy Policy, and any claim or dispute relating to it is governed by the laws of the State of new York applicable to contracts made and performed there without regard to its conflicts of law principles.

Severability

If any provision of this Agreement is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severed and will not affect the validity and enforceability of any remaining provision.

PRIVACY POLICY


We know that you care how information about you is used and shared. This Privacy Policy describes the way that we collect and handle information we collect on line from users of the Nextbook.org Site. This Privacy Policy is incorporated into the User Agreement that governs the use of Nextbook.org. By visiting Nextbook.org or submitting your personally identifiable information to us, you accept the terms described in this Privacy Policy.

Changes to this Policy

From time to time we may revise this Privacy Policy. Please review these web pages periodically for changes. Unless we explicitly require your consent to any of the new provisions, they will be effective as soon as they are posted and your continued use of Nextbook.org after such time indicates your agreement to the modified terms. You are responsible for updating your personal information to provide us with your current email address.

Collection and Use of Information

This section describes the types of information we collect and the purpose for collection.

Personally identifying information. We collect personally identifying information that you voluntarily submit in order to receive email alerts or postal mailings with news digests, program information, and information about our other services, to submit letters to our editor, to sign up for one of our events and to purchase tickets for certain events. To receive information or submit letters to the editor, we ask that you submit your first and last name, email address, phone number and postal address. We use the personally identifiable information you submit solely to fulfill your requests, or, in the case of letters to the editor, to contact you to verify authorship of your letter. If you use our "email this article" feature, we will ask for your email address and name, and the email address and name of the recipient. We use this information solely to send the article by email to the recipient you designate, and we do not keep or store the information in any database. If you purchase event tickets through Nextbook.org, we collect your credit card information in addition to your name and addresses for billing and mailing. We retain your credit card information for only so long as we are required to do so by the applicable bank, after which time we will dispose of it in a secure manner.

Anonymous information. From our server, we automatically collect certain anonymous information, such as the number of users visiting each page of Nextbook.org, the IP address of each user's computer, the browser each user employs, and the sites from which users link to Nextbook.org. We may also use cookies to track traffic on specific areas of Nextbook.org. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your web browser to enable our systems to recognize your computer. If you choose, you can remove our cookies by using the disabling function on your Internet browser. But if you remove our cookies, you will not be able to participate in any of the reader services that Nextbook offers (e.g., online ticket ordering, news digest sign-ups, or creating a reading list) because you will not be able to log into your account. We use all this anonymous information on an aggregate basis to evaluate how our visitors use and navigate Nextbook.org so that we can continue to refine our site. We do not link this anonymous information to the personally identifiable information that you submit.

Surveys. At times we may conduct surveys on a voluntary and anonymous basis. You are not required to participate in the surveys.

Transfer of Information to the United States

If you are located outside of the United States, please note that the information you provide to us will be transferred to the United States and that by registering with Nextbook.org or ordering any of our products or services, you consent to this transfer and the storage, processing and use of this information in the United States, and the transfer of it to permitted third parties.

Sharing Information

We do not rent or sell your personally identifying information. We may share the personally identifying information of users who reside within the United States with reputable organizations that offer information and programming that we think may be of interest to you. Nextbook shares only names and U.S. mailing addresses and restricts disclosure solely to vendors responsible for mailing information about events and programming. Those vendors must destroy your personal information after the mailing has been completed. If you do not wish us to share your information, please check the "opt-out" box when you sign up, or contact us at mail@nextbook.org.

We also share your personally identifying information with companies that assist us in delivering electronic and postal mailings, provide maintenance for Nextbook.org, or help facilitate our events. These companies will use your information solely to provide these services to us.

In the unlikely event of a transfer of ownership of Nextbook, Inc., such as merger with another organization, we reserve the right to transfer your personal information. Your opt-out choices will not affect our right to transfer your personal information to a successor in these circumstances.

We may disclose and use personally identifiable information in special circumstances when it is necessary to enforce our User Agreement or this Privacy Policy, or when we, in good faith, believe that the law requires us to disclose your personal information to third parties.

Your Access to Your Information

Children

Children under the age of 13 are not permitted to use Nextbook.org. We will not knowingly collect information from children under the age of 13, unless it is to respond to a one-time request, after which we will delete the information.

Security

The personally identifiable information we collect about you is stored on a secure, password-protected server. We use other security measures, including appropriate communications protocols, to protect against unauthorized access to your communications. Only authorized personnel have access to your information. Despite our best efforts, however, no transmission over the Internet can be guaranteed to be 100% secure. Therefore you provide us with your information at your own risk.
